DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

This DMCA Policy explains how TEORU, operated by Calvra Group LLC, (“Teoru”, “we”, “us”, or “our”), responds to copyright infringement claims in accordance with the United States Digital Millennium Copyright Act, 17 U.S.C. §512.

Teoru operates as an online service provider and seeks to qualify for safe harbor protections under applicable law.

1. Respect for Intellectual Property

Teoru respects the intellectual property rights of others and expects users of the Platform to do the same.

We respond expeditiously to properly submitted copyright infringement notices that comply with the requirements of the DMCA.

2. Platform Role & Content Responsibility

Teoru is a verification-focused marketplace. Submitted assets may undergo review for:

  • Quality
  • Originality signals
  • Licensing clarity

However:

  • Verification does not constitute a legal guarantee of non-infringement.
  • Teoru does not independently verify ownership documentation for every submission.
  • Creators remain solely responsible for ensuring they have the lawful right to distribute uploaded content.

This policy exists to provide a structured legal process for resolving copyright disputes.

3. Filing a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of one, and believe that content on Teoru infringes your copyright, you may submit a written DMCA takedown notice.

Your notice must include all of the following:

1. Identification of the copyrighted work claimed to have been infringed

  • If multiple works are involved, provide a representative list.

2. Identification of the allegedly infringing material, including:

  • Direct URL(s) to the specific asset(s)
  • Product title(s)
  • Creator username(s)
  • Description of where the material appears on the Platform

3. Your contact information:

  • Full legal name
  • Mailing address
  • Telephone number
  • Email address

4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

6. Your physical or electronic signature.

4. How to Submit a DMCA Notice

5. What Happens After We Receive a Valid Notice

Upon receipt of a valid DMCA notice, Teoru may:

  • Acknowledge receipt
  • Remove or disable access to the allegedly infringing material
  • Notify the creator who uploaded the content
  • Provide the creator with a copy of the notice (with personal information redacted where appropriate)

Teoru reserves the right to request additional information if a notice is incomplete, ambiguous, or appears defective under the DMCA.

We also reserve the right to reject notices that fail to comply with statutory requirements.

6. Counter-Notification Process

If your content was removed due to a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include:

1. Your name, address, telephone number, and email

2. Identification of the material that was removed and its prior location

3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification

4. A statement that you consent to the jurisdiction of the Federal District Court:

  • For your judicial district (if located in the U.S.), or
  • For any judicial district in which Teoru may be found (if located outside the U.S.)

5. A statement that you will accept service of process from the person who submitted the original notice

6. Your physical or electronic signature

7. Restoration of Content

If a valid counter-notification is received, Teoru may:

  • Forward the counter-notification to the original complainant
  • Restore the material within 10-14 business days

Unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Teoru reserves discretion as permitted under law.

8. Repeat Infringer Policy

Teoru maintains a policy of terminating accounts that repeatedly violate intellectual property rights.

We may take actions including:

  • Permanent account suspension after multiple validated infringement claims
  • Removal of associated listings
  • Forfeiture of earnings where permitted under applicable agreements
  • Restriction from future access to the Platform

This policy applies regardless of intent. Creators are responsible for ensuring they have the lawful right to distribute their content.

9. Misrepresentation Warning

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents:

  • That material is infringing, or
  • That material was removed due to mistake

May be subject to liability for damages, including costs and attorneys' fees. You should only submit a notice if:

  • You are the copyright owner or authorized agent
  • The material genuinely infringes your rights
  • You understand the legal consequences of submitting a false claim

10. Safe Harbor Statement

Teoru operates as a service provider and seeks to qualify for safe harbor protection under the DMCA by:

  • Responding expeditiously to valid takedown notices
  • Implementing and enforcing a repeat infringer policy
  • Not inducing or encouraging infringement
  • Maintaining a designated agent for notice receipt

Nothing in this policy constitutes an admission of liability.
